There’sacommonbeliefthatcyberspacecannotberegulatedthatitis,initsveryessence,immunefromthegovernment’s(oranyoneelse’s)control.Codearguesthatthisbeliefiswrong.Itisnotinthenatureofcyberspacetobeunregulable;cyberspacehasnonature.”Itonlyhascodethesoftwareandhardwarethatmakecyberspacewhatitis.ThatcodecancreateaplaceoffreedomastheoriginalarchitectureoftheNetdidoraplaceofexquisitelyoppressivecontrol.Ifwemissthispoint,thenwewillmisshowcyberspaceischanging.Undertheinfluenceofcommerce,cyberpsaceisbecomingahighlyregulablespace,whereourbehaviorismuchmoretightlycontrolledthaninrealspace.Butthat’snotinevitableeither.Wecanwemustchoosewhatkindofcyberspacewewantandwhatfreedomswewillguarantee.Thesechoicesareallaboutarchitecture:aboutwhatkindofcodewillgoverncyberspace,andwhowillcontrolit.Inthisrealm,codeisthemostsignificantformoflaw,anditisuptolawyers,policymakers,andespeciallycitizenstodecidewhatvaluesthatcodeembodies.
