There’sacommonbeliefthatcyberspacecannotberegulated—thatitis,initsveryessence,immunefromthegovernment’s(oranyoneelse’s)control.Codearguesthatthisbeliefiswrong.Itisnotinthenatureofcyberspacetobeunregulable;cyberspacehasno“nature.”Itonlyhascode—thesoftwareandhardwarethatmakecyberspacewhatitis.Thatcodecancreateaplaceoffreedom—astheoriginalarchitectureoftheNetdid—oraplaceofexquisitelyoppressivecontrol.Ifwemissthispoint,thenwewillmisshowcyberspaceischanging.Undertheinfluenceofcommerce,cyberpsaceisbecomingahighlyregulablespace,whereourbehaviorismuchmoretightlycontrolledthaninrealspace.Butthat’snotinevitableeither.Wecan—wemust—choosewhatkindofcyberspacewewantandwhatfreedomswewillguarantee.Thesechoicesareallaboutarchitecture:aboutwhatkindofcodewillgoverncyberspace,andwhowillcontrolit.Inthisrealm,codeisthemostsignificantformoflaw,anditisuptolawyers,policymakers,andespeciallycitizenstodecidewhatvaluesthatcodeembodies.
