AnexaminationofthelegalframeworkoftheEUinternalmarketasestablishedinthecaselawoftheEuropeanCourtofJustice,discussinginparticularECcompetitionlaw,thefreemovementofgoods,services,personsandcapitalandtheevolutionoftheinterpretationoftheprovisions.The'State'hasbeenretreatingfromdirectinterventionineconomiclifeasmoregoodsandservices,theprovisionofwhichwasoncethoughttobea'public'responsibility,aredeliveredthroughmarketmechanisms.GiventheneedforconsistentapplicationofEClawintheinternalmarket,acommoncoreconceptionofpublicauthority,shieldedfromthedisciplineofECcompetitionlaw,isneeded.Theresultingrealignmentofpublicandprivatefunctionsandresponsibilitiesisnotalinearandcoherentprocess,especiallyinlightofthechangingnatureoftheEuropeanlegalintegrationprojectandtheprogressiveincorporationofnon-economicvaluesintheTreaties.
