ThemanuscriptofthepresenttextbookhasbeenusedforacoursetaughtbytheauthorfortheLL.M.PrograminChineseLawatTsinghuaUniversitySchoolofLawfrom2005to2010.ThemainobjectiveofthiscourseistoprovideinternationalstudentswithbasicknowledgeofChinesecivilprocedureandtheconflictoflaws.Inparticular，thecourseexpoundscivillawsuitsthatarefiledinaccordancewiththeChinesecodeofcivilprocedure（CivilProcedureLawofthePeople'sRepublicofChina），otherstatutesandjudicialinterpretations，aswellaschoiceoflawrulesdeterminingthelawapplicabletocivilrelationshipsinvolvingforeignelements.Thecourseprovidessuccinctexplanationsofessentialissues，fundamentalprinciplesandparticularinstitutionsinChinesecivilprocedureandtheconflictoflaws.ThetextbookbeginswithasurveyoftheChineseprocedurallawandanoverviewofChinesecivilprocedureandthenfocusesonessentialaspectsofcourtjurisdictionandtrialprocedureincivilmatters.InviewofthetraditionalimportanceofalternativedisputeresolutioninChina，mediation（conciliation）andarbitrationarealsodiscussedwithcorrespondingcomparisonstocivilprocedure.Thetextbookalsodiscussesissuesrelatingtotheconflictoflaws，i.e.internationaljurisdictionundertheChineseinternationalcivilprocedurelaw，recognitionandenforcementofforeignjudgmentsaswellasChinesechoiceoflawrules.FocusisdirectedtowardtheChineseStatuteontheApplicationofLawstoCivilRelationshipsInvolvingForeignElementsof28October2010，whichenteredintoforceon1April2011.Twoappendixesareprintedattheendofthetextbook："Addendum1：ChineseStatutoryConflictRulesandConflictRulesContainedinJudicialInterpretationsPriorto1April2011"and"Addendum2：StatuteontheApplicationofLawstoCivilRelationshipsInvolvingForeignElementsofthePeople'sRepublicofChina"whichhasbeentranslatedintoEnglishjointlybyProfessorCHENWeizuoandMr.KevinM.Moore.
