ThemanuscriptofthepresenttextbookhasbeenusedforacoursetaughtbytheauthorfortheLL.M.PrograminChineseLawatTsinghuaUniversitySchoolofLawfrom2005to2010.ThemainobjectiveofthiscourseistoprovideinternationalstudentswithbasicknowledgeofChinesecivilprocedureandtheconflictoflaws.Inparticular,thecourseexpoundscivillawsuitsthatarefiledinaccordancewiththeChinesecodeofcivilprocedure(CivilProcedureLawofthePeople'sRepublicofChina),otherstatutesandjudicialinterpretations,aswellaschoiceoflawrulesdeterminingthelawapplicabletocivilrelationshipsinvolvingforeignelements.Thecourseprovidessuccinctexplanationsofessentialissues,fundamentalprinciplesandparticularinstitutionsinChinesecivilprocedureandtheconflictoflaws.ThetextbookbeginswithasurveyoftheChineseprocedurallawandanoverviewofChinesecivilprocedureandthenfocusesonessentialaspectsofcourtjurisdictionandtrialprocedureincivilmatters.InviewofthetraditionalimportanceofalternativedisputeresolutioninChina,mediation(conciliation)andarbitrationarealsodiscussedwithcorrespondingcomparisonstocivilprocedure.Thetextbookalsodiscussesissuesrelatingtotheconflictoflaws,i.e.internationaljurisdictionundertheChineseinternationalcivilprocedurelaw,recognitionandenforcementofforeignjudgmentsaswellasChinesechoiceoflawrules.FocusisdirectedtowardtheChineseStatuteontheApplicationofLawstoCivilRelationshipsInvolvingForeignElementsof28October2010,whichenteredintoforceon1April2011.Twoappendixesareprintedattheendofthetextbook:"Addendum1:ChineseStatutoryConflictRulesandConflictRulesContainedinJudicialInterpretationsPriorto1April2011"and"Addendum2:StatuteontheApplicationofLawstoCivilRelationshipsInvolvingForeignElementsofthePeople'sRepublicofChina"whichhasbeentranslatedintoEnglishjointlybyProfessorCHENWeizuoandMr.KevinM.Moore.
